Terms and Conditions of cab services :

If you have questions regarding our terms and conditions of cab services for RtcYatra®, we have answers !

The customer shall pay the cab fare as per the applicable fares and payment schedules mentioned on the website of RtcYatra at the time of booking !
The customer shall not pay toll charges, state tax and any other fee or levy presently payable or imposed hereinafter under applicable laws for availing the cab services because all included fares will be mention on the website of RtcYatra at the time of booking !

In the plan area, minimum pick up time is 45 working minutes and maximum is 120 working minutes after confirmation of booking. This pick up time can be reach up to 12 working hours if your pick up location is in hill areas. RtcYatra has rights to cancel your booking any time if vehicle is not available due to any reason. The booking amount will be refund in the same receipt account according to our cancellation policy !

The parking will be extra from fares if pick up location from airport or you have suggest any parking to driver or you booked for signseens or you are using rental cab for your multiple local areas travelling which is not have outside parking space and parking is chargable !

The customer agrees and acknowledges that no refund shall be provided if the cancellation information is received after the reporting time of the cab !
If cancellation request is received before scheduling the pickup, convenience charge as per cancellation policy would be deducted from the amount which has been booked for travel as preauthorization or advance !
The cancellation can be done over the phone but not later than scheduled the pickup. All cancellation to be made against the booking is provided at the time of booking the cab !
The customer agrees and acknowledges that the use of the services offered by RtcYatra is at the sole risk of the customer !
RtcYatra disclaims all representations and warranties of any kind whether express or implied as to condition, suitability, quality, merchantability and fitness of the services offered by RtcYatra !
The liability of RtcYatra is excluded to the fullest extent permitted by law !

RtcYatra shall not be responsible or liable for any loss or damage, howsoever caused or suffered by the customer arising out of the use of cab service offered by RtcYatra or due to the failure of RtcYatra to provide services to the customer for any reason whatsoever including but not limited to the customer non compliance with the services recorded voice instructions, malfunction, partial or total failure of any network terminal, data processing system, computer tele transmission or tele communications system or other circumstances whether or not beyond the control of RtcYatra or any person or any organization involved in the above mentioned systems !

Upon the demand of RtcYatra, the customer shall indemnify RtcYatra from and against and in respect of any or all liabilities, losses, charges and expenses including legal fees and costs on a full indemnity basis claims, demands, actions and proceedings which RtcYatra may incur or sustain directly or indirectly from or by any reason or in relation to the use or purposed use of the services provided by RtcYatra !

RtcYatra is hereby authorized to use the location based information provided by any of the tele communication companies regarding the use of mobile phone by the customer for making a cab booking !
However, the location based information will be used only to facilitate and improve the probability of locating a cab for the customer !

RtcYatra shall be entitled to disclose the particulars of the customer in possession of RtcYatra to all companies controlled by RtcYatra or any of its authorized chauffeurs or any government body as required by the laws !

Directive or request from any government body or to any third party deemed fit and proper by RtcYatra in it is absolute discretion !

RtcYatra shall be entitled to terminate any booking at any time without giving any reason or prior notice to the customer !

RtcYatra encourages all it is customers to take full responsibility of their luggage or belongings !
In case of any loss, from the cab during the journey, RtcYatra shall endeavor to locate the lost luggage or belongings on a best effort basis but RtcYatra shall not be held responsible for such loss or damage !

If the customer leaves any luggage or belongings or goods in the cab or has any complaint in respect of the services or the use of the cab, the customer shall make a complaint in writing to RtcYatra within 24 hours from such usage !

In case of any dispute arising between the customer and RtcYatra, the dispute shall be referred to an arbitrator which will be appoint by RtcYatra in it is sole discretion !
The arbitrator so appointed by RtcYatra shall act in conformity with the arbitration and conciliation Act, 1996 !
The award so passed by the arbitrator shall be binding upon the customer as well as RtcYatra !
The courts of Dehradun, Uttarakhand shall have the sole and exclusive jurisdiction in respect of any matters which may be instituted before any court of law, arising from the use of the services offered by RtcYatra !

RtcYatra shall be entitled to add, vary or amend any or all of these terms and conditions at any time at it is sole discretion and the customer shall be bound by such addition, variation or amendment incorporated or made in these terms and conditions with effect from the date set forth by RtcYatra !

RtcYatra shall be entitled to record all the calls made to the call centre of RtcYatra for quality and training purposes !

Vehicles registered with RtcYatra may be continuously tracked by RtcYatra using mobile for security reasons or for reasons deemed fit and proper by RtcYatra !

By logging on the account access service on RtcYatra websites, the user hereby authorizes RtcYatra and it is agents to access third party sites, including that of banks and other payment gateways, designated by them or on their behalf for retrieving requested information !
While registering, the user will set a login token and the user is responsible for maintaining the confidentiality of the token and the account !
The user is fully responsible for all the activities that may take place whilst using their token or account !
It is the duty of the user to notify RtcYatra immediately in writing or mail of any unauthorized use of their token or account or any other breach of security !
RtcYatra will not be liable for any loss that may be incurred by the user as a result of unauthorized use of customer token or account, either with or without his or her knowledge !

The user shall request RtcYatra for any refunds against the unutilized or no show cab booking for any reasons within 24 working hours from the hour of departure !
Any applicable refunds would accordingly be processed as per the defined cancellation policies of RtcYatra, it may take upto one week to get refund as per the bank norms or process !
No refund would be payable for any requests made after the expiry of 24 hours as mentioned above and all unclaimed amounts for such unutilized or no show booking shall be deemed to have been forfeited !

RtcYatra may send booking confirmation, itinerary information, cancellation, payment confirmation, refund status, schedule change or any such other information relevant for the transaction, via whatsapp or sms or by voice call on the contact number given by the user at the time of booking !
RtcYatra may also contact the user by voice call, whatsapp or sms or email in case the user could not or has not concluded the booking, for any reason what so ever or to know the preference of the user for concluding the booking and also to help the user for the booking !
The user hereby unconditionally consents that such communications via whatsapp or sms or voice call by RtcYatra !

The user warrants that the user shall abide by all such additional procedures and guidelines, as modified from time to time, with respect to the use of RtcYatra cab services !
The user further warrants that the user shall comply with all the applicable laws and regulations regarding the cab services provided by RtcYatra !

Unless explicitly provided by RtcYatra, any specific service or deliverable, obtaining sufficient insurance coverage shall be the obligation or option of the user and RtcYatra not accept any claims arising out of such contingencies !

Insurance cover, if any provided as a part of the service or product by RtcYatra shall be based on the terms and conditions of the insuring company !
The user shall contact the insurance company directly for any claims or disputes which may arise out of such insurance cover !
RtcYatra shall not provide any express or implied undertakings for acceptance of the claims by the insurance company !

The following conditions will be considered as car missuse. The customers will be fined if found involved in any of the following conditions !
Over speeding : The user will force or allow to drive the vehicle more than maximum speed of 80 kilometres per hour, beyond which the vehicle will be considered as over speeding. A penalty of 200/- will be charged on the first instance, followed by a further penalty of 500/- and 1000/- for 2nd instance and 3rd instance respectively making it a total of 1,700/- at third instance. After the third instance, the booking will stand cancelled and the company shall get the right to take back the vehicle and terminate customer service !
Traffic violation : The customer will liable to pay for any traffic violation tickets received during their journey if he allow or force to driver for traffic violation. RtcYatra can charge traffic violation from the customer legally on actual if the violations tickets are sent directly to the company by the traffic department !
Car spare part changed : The customers should not change or remove any car spare parts. In case of emergency, the customer should inform RtcYatra and act as per advice. The customer will be charged a penalty of 5,000/- over and above the cost of spare part !
Tyre missuse : In case of any tyre damages resulting from driving in bad terrain and continued driving in case of tyre puncture, customers will be charged for the cost of tyre on actual !
Running vehicle in damaged conditions : The customer are not advised to drive the car if it gets damaged in an accident. The customer are advised to inform RtcYatra immediately. In such case, customers will be charged for the cost of spare parts on actual !
Unauthorized activity in the car : The customer is not allow to carry arms, ammunitions and banned drugs. In addition, use of car for commercial activity such as product sell, promotion and carry goods is strictly prohibited. In such case, customers will be charged for the cost of penalties according to related government departments !
External branding : Any form of external branding on the car is prohibited. The customer is not allow to paste or paint any external brand promotion on the car. The customer will have to pay a penalty of 5,000/- !
Tampering with devices : The customer is not allowed to tamper with the odometer, GPS device and in car technology devices. The customers will have to pay a penalty of 2,000/- and over in addition to the actual cost of the device !
Deliberately driving the car in water : The customer will be charged for the actual cost of repair and spare parts !
Producing fake and tampered personal documents : is strictly prohibited !
Diversion : The customer is not allow to drive the car into unauthorized or government banned areas. The customer is advise to inform RtcYatra in case they change the course of their trip. The customer have to pay a penalty of 10,000/- if the car trespasses into banned areas, naxal hit areas, international border of republic of India !

Please note that all bookings are subject to availability of vehicles and all disputes relating to the cab services of RtcYatra are subject to exclusive jurisdiction of Dehradun Uttarakhand courts only !
